TERMS & CONDITIONS
1. Scope of Works
The services to be provided by FJP Co Pty Ltd t/a Resin Me Epoxy (ABN 63 670 338 682) ("Resin Me Epoxy") are detailed in the accepted quotation and may include commercial concrete grinding, floor preparation, glue, coating or screed removal, concrete polishing, grind-and-seal systems, epoxy flooring, concrete repairs and approved equipment hire. Only work expressly included in the quotation forms part of the agreed scope.
The quotation provided is based on the scope of work and specifications provided by you (the "Client") at the time the quotation is issued. Resin Me Epoxy reserves the right to vary the quoted price and delivery timeframe to reflect any agreed variations.
The quotation is valid for a period of 30 days from the date of issue.
Removal from the work surface is included only where stated in the quotation. Loading, transport and lawful disposal of waste or removed materials are excluded unless expressly included and may attract additional charges.
The quotation will state whether Resin Me Epoxy supplies portable three-phase power. Where power, water or other site services are not expressly included, the Client must provide safe, suitable and uninterrupted access to the services specified in the quotation. Delays or additional costs caused by unavailable or unsuitable site services may be treated as a variation.
Any additional work outside the scope of the quotation that is requested by the Client, or required for Resin Me Epoxy to complete the services in the attached quotation, will be subject to additional charges.
2. Acceptance of Quotation
By accepting this quotation, the Client agrees to be bound by these Terms and Conditions. Acceptance may be communicated in writing, by email, or by instructing Resin Me Epoxy to proceed with the works.
3. Delays
The parties acknowledge and accept that adverse weather conditions and other events outside of Resin Me Epoxy's reasonable control may cause delays in the commencement, progress, or completion of its services. Resin Me Epoxy will not be liable for any loss, damage, or delay caused by such weather events or circumstances beyond its control. Any timeframes for completion will be extended by a reasonable period to account for such delays.
4. Payment Terms
The Client must make payment in full for any invoices issued, or upon request by Resin Me Epoxy for payment of its services, within 14 days of the date of any invoice or request for payment, unless otherwise agreed in writing.
Payment must be made via bank account, the details of which will appear on the invoice, or otherwise as directed by Resin Me Epoxy.
All materials and work remain the property of Resin Me Epoxy until all undertaken work and materials are paid in full.
The Client agrees to indemnify Resin Me Epoxy against all costs, claims, damages and expenses suffered or incurred as a result of the Client's failure to make payment of any invoices or requests for payment.
5. Variations
Any variations to the scope of works must be agreed in writing. Additional charges may apply for any agreed variations.
6. Warranty
Any workmanship warranty offered by Resin Me Epoxy applies only for the period and to the services expressly stated in the quotation. Manufacturer warranties for supplied products or equipment remain subject to their separate terms.
If completed work covered by an express workmanship warranty is found to contain a qualifying defect within the stated warranty period, Resin Me Epoxy will inspect the issue and, where the warranty applies, rectify the affected work within a reasonable time.
A warranty claim must include reasonable evidence of the work and alleged defect. Express workmanship warranties do not cover damage or failure caused by substrate movement, moisture or contamination outside the agreed preparation scope, third-party work, misuse, impact, chemicals, inadequate maintenance, or conditions disclosed or excluded in the quotation.
Any express warranty provided by Resin Me Epoxy is in addition to, and does not exclude, restrict or modify, any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
If an inspection or remedial work shows that the issue is outside the agreed warranty or results from an excluded cause, reasonable inspection, travel and rectification costs may be charged after notice to the Client.
7. Australian Consumer Law Guarantee
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and receive a refund for the unused portion, or compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods.
If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified within a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
8. Termination
Resin Me Epoxy may terminate the agreement immediately and cease work if the Client fails to pay any payment claims or invoices, fails to provide adequate instructions, or otherwise with 7 days' written notice. The Client must pay for all charges and expenses incurred up to the date of termination, including any materials ordered and labour undertaken following the Client's acceptance of the quotation.
9. Limitation of Liability
To the extent permitted by law, Resin Me Epoxy's liability for any claim arising out of or in connection with the services described in the quotation is limited to the value of the services provided under the quotation.
10. Governing Law
These Terms and Conditions are governed by the laws of New South Wales.
11. Entire Agreement
These Terms and Conditions, together with the attached quotation, constitute the entire agreement between the parties and supersede all prior discussions or agreements.
